Dear Kaveri Enclave Members,
We would like to bring your attention and seek your support for resolution of the dispute against the issues generated by Mr. Srinivas Reddy with reference to the building he has builtin front of our KERWA office situated at #77, 2nd cross, kaveri enclave, 9th cross, Kanshiramnagar, Bangalore - 560097.
We have raised the following issues with relevant authorities, however, he has decided to ignore it and move ahead with his plans. Recently, he has gone ahead and cut the flag pole which was being used by our association for several years. When we attempted to fix it at our expense, he stopped the work and did not allow us to proceed. As per the advice of Vidyaranyapura Hoysala, we visited the Gangammagudi police station. We submitted all the proof and were adviced that he has clearly violated the orders of the court and we need to proceed to file case of "contempt of court" to seek further resolution in this matter.
We will be proceeding to request our local MLA Sri. S Muniraju to support us resolve this dispute amicably.
This is a petition and formal protest regarding the following greviences for which we seek immediate resolution:
1) Encroachment on Association Land: It has been observed there is encroaching on the land specifically designated for the KERWA office. This is a direct violation of the community’s collective property rights.
2) Failure to Maintain Agreed Walkway: There was a clear agreement to maintain a 3-foot walkway for residents to enter the office. This has not been maintained
3) Unauthorized Removal of Property: We are particularly concerned about the **removal of the association’s flag pole** during the night without any prior consultation or consent from the association especially when there is a court order stating he does not have the authority to do so.
4) Illegal water connection: He has illegally connection to our borewell pipe without any discussion with the association and without any payments that has been set for all residents of the layout which has been borne by all the residents of this layout.
We are currently organizing a **signature campaign** for the residents to document the collective disapproval of these actions.
Our request is for Mr. Srinivas to address and resolve these issues immediately:
1. Cease all encroachment on the association office land space.
2. Ensure the 3-foot walkway is maintained as previously agreed.
3. Reinstate the flag pole
4. Either pay for the water connection as all the other residents of the layout or disconnect and find alternate resources.
We hope to resolve this matter amicably and restore the standards of our residential community. However, the association reserves the right to take further formal action if these issues are not rectified promptly.
